Discrepancies
Regarding the Pursuit and Death of Richard Owens
Officer
Bukowski states in his report that he did not have video tape to record
the pursuit, yet one of the dash cam videos I received from the WFPD is
tagged from Bukowski's patrol unit.

"I
was driving unit 5918 during the pursuit. I did not have working video
tape during the pursuit because it had run out at the beginning of
shift. I notified Sgt Yonts at 0050 hrs (approximate) that I needed a
new tape but he was busy at the time and we were going to try to take
care of it at a later time."
Patrick was
Rick’s passenger. Police removed Patrick from the Tracker
during
the traffic stop at 10th and
Baylor (top right corner of map).
Immediately upon
arrival at the scene of the collision, Rutledge exits his vehicle to
check on the
occupants of the Tahoe and Tracker. While Rutledge and Yonts are
conversing in front of Rutledge's patrol car, Patrick's voice is
recorded inside Rutledge's patrol car.

Rutledge's
report states he was at Kemp and Kell East (bottom
left of the map) when the pursuit started. If this is true, how did
Patrick get inside Rutledge's patrol car?
Unidentified Figure at Collision

taken from unit #5937's dash cam video of the pursuit. The figure
appears to be picking up or pulling on something.
I’ve questioned for some time now if stop spikes were used
and this is
being kept secret because stop spikes open a question of liability
under Texas law.
In
the evidence video, an officer in full blackout is shown
working the scene of the collision. Since when do officer's
wear full blackout at the scene of a collision?

Where
are the radio transmissions for the request and return of a DL check
on Mr. Owens and/or the passenger in Mr. Owens vehicle? We know a DL
check was ran b/c at (00:33) the officer clearly states there is an SR
suspension on Mr. Owens.
At (2:29) officer
references/lists items
inside Mr. Owens vehicle. Obviously/apparently a search of the vehicle
took place. Note that clothing is mentioned-Mr. Owens clothing was
inside a suit case meaning a certain amount of time was taken in order
for the suitcases to have been opened and the clothing seen.
False Accusations of
Injury
to an Officer
In news reports
immediately following the pursuit, police stated
Richard Owens was pursued because of an outstanding traffic warrant. 2
days later, when local news agencies and the community questioned the
decision to pursue over a minor traffic
offense, police then began a new claim that an officer was injured when
Richard
Owens fled the traffic stop.
Yet injury
to
an officer is not listed in the case report (see below), nor
is there any reference to an officer being injured in the radio
transmissions
made during the
pursuit.

Police
stopped Owens for outstanding traffic warrants and Owens was told he
was under arrest. At that point Owens sped off, injuring an officer
as he tried to escape, Sgt. Cindy Walker said.
"If
he's going to injure an officer, what's he going to do to a citizen?
You've got to get him off the streets."

Initial
reports said police pursued Owens for traffic warrants and driving
with a suspended

An
internal investigation of the chase cleared the officers in the
chase. During the investigation it was determined
Owens injured an
officer as he drove away from the traffic stop, Sgt. Cindy Walker
said Thursday.
"He
was placed under arrest and then he escaped and injured an officer,"
Walker said. "That's two felonies."
Officers ignored
and broke a multitude of directives set forth in the policy, yet not a
single reprimand or disciplinary action was taken against officers
involved in the pursuit. Perhaps
more interesting than the policy itself, are the sections removed from
the policy.
Unanswered
Questions
Why has the Police Department refused to release the dash cam video of
the original traffic stop?
Why has the Police Department refused to release a copy of the lead
officer's police report?
Why do both dash cam videos cut to static seconds before the collision,
then cut back after the collision?
Police
procedure is to remove the driver of a vehicle to insure safety of the
officers and driver. Why was the passenger removed, yet the driver,
Mr.Owens was left in full control of his
vehicle?
Why is there a Custodial Death Report included in reports when Mr.
Owens was never in police custody?
Why
did the City Attorney create and submit to the Attorney General a fictional
affidavit against me in
their request for non-disclosure?
Why was the presence of Rick's passenger in Rutledge's patrol car
during the pursuit kept secret?
